I understand that the cost of patent litigation is relatively low until they get to a hearing. And, it's all pretty bulkhead kinds of work, much of which might need to be done by the infringer even without litigation to define the degree of infringement (or lack of)and thus the license value/cost.

A 1 year delay of a license payment of $5 M could be worth $200K or more to the infringer. Should we expect this sort of process (negotiate for as long as possible then initiate litigation, and settle just before the hearing) will be common as we go foreward. That would seem a smart thing for infringers to do - a multi year delay.
