The case could still be pending because the J's have not completed payment for the settlement amount agreed to by the parties. The MOU could be a vehicle used to assure payment in a case that is dismissed by the court after parties agree to settlement. Now perhaps the J's are waiting for a PTO ruling on several patents and there is an agreement by the J's only to pay on validated patents, hence the reason it is still pending. We just do not know, but since the company said there is no more coming from the J's settlement, I don't think there is an agreement to pay more than the settled amount. I would like to believe there is more coming, but I have to take the company at its word.
