Sometimes they issue a reexam finalization before a litigation search or even without one....the ones I have been involved with are listed below...and there were cases on hold in district court waiting for the reexam results at the time...so it is not actually a necessity to see a litigation search before they render a decision...but it wouldn't surprise me if they do so in our reexams. Also remember that our reexams a based on a case of "obviousness" where my others ones were stricitly a case of prior art or not.
