The EPO's decision is not binding on member states other than the respective national court will note the ruling and may find it persuasive.

It is my very humble opinion that the EPO confirmation will be used in support of patent validity currently under USPTO reexamination. I also believe that litigation in Europe in highly unlikely, with the EDoT being the favored venue for any alleged infringement.
