Speculation is NOT fact.

Absolutley correct...but remember that when the time comes and the speculation goes rampant on the $5/share, and "patents on water" posts start to hit again..esp. if the reexams come back in our favor...

Besides the information provided is factual...it was in a German Court...it was a case against the patent validity, it was not revealed in any Q or K either in the Litigation section or the Risk Factor section, we have always been notified by either a PR or Q or K to inform us of such action...(even though we have enough posters scanning the PUBLIC file at the PTO) and we do have both of our leading officers signing the Sarbane-Oxley forms saying there was nothing omitted from the Q's and the K that was material to the company or its future....

If there is specualtion here it is minimal IMHO. And if all of this only commenced after the last quarter-ending then I retract all of the required information that I and you should see there...

But then a PR letting us know of this or even better...the Q and K have a Subsequent Event section too where it could have been unveiled to us.
