Looks like Acer has ultimately won it's battle to change venue by filing suite against TPL first in California where they will have a better chance of winning.

Perhaps TPL could use this tactic to file suite against other companies in Germany and use the German court system which seems to be more favorable towards the MMP than the court system in the U.S.
