No I don't know this for sure to be true. Who amoung us really knows exactly what's going on at TPL. We can only make judgements with the facts we have at hand. We know licenses started and were cheap for first movers and forward thinking companies. We know that the licensing has dried up for the most part. Most likely because of the rejections of claims on the patents by the USPTO. Companies have probably decided to wait out the USPTO actions rather than pay an increased fee now just in case the patents are weakened or invalidated by the USPTO. TPL has told us this plan from the beginning. To our surprise we now know the Euopean equivalent to the MMP was found to be valid in Germany. We know that TPL is hiring staff in their European office. I do think this also plays well for TPL to not license as many companies during this time period until the USPTO actions are completed as this puts more dollars in their pocket in the long run. I think the latest news from Germany has provided a place for TPL to start getting more aggressive in the licensing efforts of companies in Germany and possibly the rest of Europe. Most believe the USPTO decision will come within months not years and what happens from now in Germany and potentially all of Europe, should give us a window into what a revalidation by the USPTO will do for us in the rest of the world.
