IMO and from the three reexams I have been associated with.....which could or could not apply here....when there was a litigation search it usally was followed by an Office Action (OA) at the PTO. Sometimes a few days after and up to around 2 weeks after the search.

The other scenario that I have been accoustomed to was that when the reexam file showed an "Intent to Issue a Reexamination Certificate"...meaning an end to the reexam, good, bad or in between, the ones I had experience with had the Litigation Search and Intent to Issue a Certificate posted and dated the same day.

Now does that mean that all the ones at the PTO go that way....probably not, but the ones I was exposed to occurred that way. Thus when I saw the latest ...litigation search posted on the PTO site...and nothing else...I opined that this could be a signal for another non-final action by the PTO....others disagreed with me...and that's fine....I hope I am wrong and this time the litigation search occurs and posts 2 weeks before the final intent to issue a reexam certificate....it's just not what I have been used to ...that's all.

It would be nice to off the mark on this aspect.
