As to Germany,
IP-Com, attacking HTC’s mobile communications handhelds. IP-Com (from Munich) obtained from the Frankfurt court a preliminary injunction (“Einstweilige Verfügung”) against HTC. This is an ex parte court order obtained without hearing HTC. Next week HTC will get its chance in the District Court (Landesgericht) Frankfurt opposing this injunction(Wednesday, March 12, 2008)

Perhaps a leaf should be taken from HTC's book, with concurrent litigation in Germany for patent infringement? I humbly suggest that the matter could be concluded before the Californian Court date based on the speed of the IPCom vs HTC case above.
With the recently revalidated patent, obtaining a preliminary injunction should pose no problems whatsoever, in my very humble opinion.
