since this company IS about MMP and little else. For RG to change the game this late meant that they expected the patents to be declared null and void

I think what RG is/was doing is positioning this company to be a potentially viable entity if the MMP was declared null and void. If he succeeds and Crossflo and Avot gain some traction then he's done his job.
