Message: what happened to the `749 (wasn`t it called parentpatent) ?

The only patent to receive a "Final Rejection" notification is the '336, and, as previously explained, this is but a step in the revalidation process: the '336 remains valid.

Could a new patent application be made for the '749?

A categorical NO for the simple reason that the clock would start running now. However, the re-examinations have allowed for the adjustments of claims within the existing patents which is tantamount to making a "new" application.

Trying to use EP 0786730 or DE 6903356 8T2 is moot because of the 30 month limit, from original application, on filing elsewhere.


In my very humble opinion, there is absolutely nothing wrong with the revalidated DE patent and I'm sure that your desired $$$ will be received because of it.
