I believe there is a time frame allotted in which the patent owner is able to file a notice of appeal, and another time frame in which the patent owner needs to file the appeal subsequent to the notice. Until those time frames expire w/o appeal, the final rejection is not final. Corrections welcomed.

I might add, that since the MMP is licensed as a group of patents, the threshhold for being material could be argued to being a rejection of the entire portfolio. The rejection of just one patent, even if FINAL in no way makes the MMP unlicenseable. And we haven't even gotten to the point where any rejection is FINAL. IMHO Opty
