New Re-Ex of '336: Interesting facts

posted on May 07, 2009 12:07AM

If you look at the different papers in the USPTO Image File Wrapper, you'll find some interesting facts:

1. There is an amendment 9, which shows Moore filed an "assignment of assignors interest" to his own "The Equinox Trust" - at the end of March 2009.

2. Exact one month later (04/24/09) Greg Gardella from Fish & Richardson, one of the biggst IP-/Litigation law companies in the US files the request for a re-ex of the '336. This guy Gardella is specialized on re-exams in the high-tech field, so he knows, how to handle this job.

3. Samuel Rimell is the examiner again - which is interesting, because he's the one, who finally rejected the '336 on 3/17/09. So what would he change with this new re-ex?

4. I cannot find, who is behind Fish & Richardson, but there is one paper, which is puzzling me: The "Bibliograpic Data Sheet", which says the following under "Applicants":

Patriot Scientific Corporation Poway, CA;

Fish & Richardson, PC (3rd PTY Rec.), Minneapolis, MN;

Greg G. Gardella, Minneapolis, MN

In 2006, when the first re-ex for the '336 started, it listed TPL (as owner) and Toshiba, now it's PTSC and NOT TPL.

5. On the side notes: According to the "Title Record" there has been NO termination of the security interests of Swartz and Lincoln so far (which have of course the exactly same adress...for all those, who still think, these are different entities), which is odd, because the security interest of the law company Knobbe, Martens etc. from 2003 was terminated in August 2005 - but not those from Swartz & Lincoln!

Anyway, this all is very strange...and by introducing Fish & Richardson, who are HUGE in the IP-business, one has to assume, there is BIG money in the game.

ALL IMHO and corrections, support and more knowledgable input welcome!
