<On March 17, 2009, about six weeks after this Court denied reconsideration of Defendants’ Motion to Dismiss, the USPTO issued a final rejection of the asserted claims of the 336 patent. Plaintiffs proposed that the ‘336 patent also be withdrawn from this case, but on April 17, 2009, Defendants declined to do so. >
