The last two request for reexam have included patents already reviewed in previous request. It would seem to me that the requestors are trying to usurp the ex-parte reexam process by using these continuous request as a form of appeal for a decision they are not happy with. Since they cannot appeal a decision they are trying an end around approach. I hope our lawyers see it for what it is and take appropiate action.
