If Crossflo can provide a pricing structure, it sure seems like they could do something similar for MMP. Something like for the first x amount of product infringment you pay $X, for the next y amount you pay $Y, etc. etc. Then it would simply be a battle of how much infringement, and not about the $$'s. Would add some transparency and a measureable metric for the market to assess licensing fees, WITHOUT TPL/PTSC losing the competitive/negotiating edge that they claim they keep this stuff secret for. If everyone was paying a rate of X, Y & Z, etc., or even just a flat royalty rate of $10 per microprocessor, etc., then the onus is on TPL to prove the infringement, NOT on some cloak and dagger game of getting IBM to pay more than Apple or HP. Each company would pay a multiple of a basic known rate and the multiple would be based on that company's product make up. Perhaps I'm missing the forest for the trees, but that sure seems to make more sense, would lead to more licensing and less resistance to licensing, and would provide the market with transparency that PTSC surely needs.
