Remember that in 2005 PTSC was not flush with cash and Swartz was keeping the doors open. The agreement between TPL and PTSC was made prior to the windfall of license revenue. Perhaps PTSC had to "poor boy" the review of the agreement as they were definitely in dire straights in those days? It's easy to judge now based on all the revenue and history that perhaps more eyes should have been on the agreement. Also PTSC did not know of any issues with Moore and TPL probably because there wasn't any at that time. It's easy to look back and judge based on what we know today. Just somthing you and Biajj should consider in your review.
