This is true BUT, the other one was already deemed incomplete. While they techinically have the opportunity to resubmit, I think IF the USPTO is already in the process of recertifying, then they have the ability to reject the resubmittal. I'm inferring from the decision put out on the '584 petition denial and you can go read that to get the jist of it, but essentially, it implies that it's too late in the game, the wheels of beauracracy have already been set in motion, and can't be stopped, etc. I'm not saying that's GOING TO happen, but it ssems to be possible IF there is a positive outcome on the '336 in the offiing.
