The final rejection on 7/21/2009 was for a challenge to our patent not the patent itself. Also reexam (challenge) 90/010457 has been denied for as being incomplete they have 30 days to refile. It would seem their grounds for challenge are on shakey ground. These were recently filed reexams filed by our current litigates and are being with swiftly. After the reexam that were submitted earlier we eliminated some claims and re-wrote others for compliance that is why there is excitement, hopefully we will be recertified soon.
