To paraphrase a recently deceased ex-President and fellow Univ of Michigan grad, “ Our long, national nightmare is over”. Congrats to all those longs, who have toughed it out and held your shares tight….I am with you. Though events may have conspired against us, I have never doubted for a minute this day would surely come. Whether it was Pubat, who initiated the 336 re-exam or not, some firm would have come forward eventually to “Run out the clock ”, in a futile attempt to forestall Judgment Day. Well that day is nigh!

A word of caution. The Great Unknown is “What’s inside the envelope?”.. I am cautiously optimistic the 336 may have escaped relatively unscathed from the USPTO examiner’s red lines, the fact of the matter “We just don’t know yet”. I believe a lot of the hysteria the last few days is centered on the common belief “The re-exam is finally done”.. People are exhausted…and elated, assuming PTSC won and the 336 Patent has been re-validated. Unchanged? Strengthened? Who knows?..

Next item. Many investors may feel companies that may have been holding back will now be incentivized to pay up quickly. Folks, we are in a severe recession, companies are hoarding cash, laying people off, delaying expansion and investment. The likelihood of PTSC being the recipient of a huge cash bonanza’s in the current economic environment is nil. Someone is going to say the patent(s) may be valid, but I didn’t infringe, so “I’ll see you in court”. Obviously, someone has to be made an example of to encourage recalcitrant firms to come forward and make restitution. IMHO, assuming PTSC/TPL can prove infringement, the likelihood of a large cash verdict is small. Companies will plead, ”You penalize me, and I will have to lay more people off”. Those words may find a sympathetic audience in the jury pool. Hopefully, our wise legal counsel (oxymoron?) will retort “Dem thieving scoundrels stole everything from us and dang near bankrupted the firm!!”..Stay tuned..
