FWIW, I asked the question of a PA and his response is below. He has no inside knowledge of the recert, just the same access to docs that we have. So, he may be wrong, or right, but I value his opinion above my own. Good luck everyone!

It looks like all issues have been resolved and Patriot is not going to appeal. The notice was filed as a precautionary measure because Patriot did not hear back regarding its response to the final office action. It thus filed a notice of appeal, in case the examiner did not accept its response to final.

Although Patriot is still preserving its right to appeal, it appears that Patriot is satisfied with the claims as amended. That could be good news, though as you know, I have only conducted a very cursory examination of the docs you sent.
