Regarding the Gazette

Not sure why there is such an interest in the Gazette publication. In case you're not aware, the NIRC does not get published in the Gazette. It will ONLY appear on the Transaction History, then on the IFW. Then about 90 days later, provided there is no contesting of the amended patent as published in the NIRC, THEN the final amended patent will appear in the Gazette and be official. There shouldn't be an expectation of anything on the '336 or the '148 in the Gazette as far as the Notice of Intent to Issue a Rexamination Certificate, only of the approved amended final patent, and then it will appear under the "Browse Granted Patents" link on the left side, and then once you've cliced there, it will show up under the "Ex-Parte Rexaminations" link.

For the '336 NIRC, look under the Transaction History tab for the 90/008,237 or the 90/008,474 application numbers. Once it appears there, and only AFTER it appears there, you can start the 90 day clock for the approved Re-Exam patent to appear in the Gazette. For example, on the '584, the NIRC was listed on the Transaction History on 4/21/09, and the official amended patent was published in the Gazette on 7/21/09.
