Obviously, a nullification action based on a procedural reasons, if successful, is a very cheap easy way to totally wipe out the patent. So why not try it first, DT had nothing to lose.
Hang on a second... then why say:
It had nothing to do with the individual patent claims.

Do you really think that the people at DT just woke up one day and decided to see which patents they could nullify for the fun of it? Or might it have been because they were concerned about potential infringement?
