note Section 11 paragraph g:

g) Notwithstanding anything to the contrary set forth in this Agreement, the parties agree that Infineon shall not be liable for and shall have no obligation to indemnify or hold harmless Buyer from or against any third party infringement claim related to the Moore Microprocessor Patent Portfolio as currently asserted by Technology Properties Limited Inc. (including – without limitation – the US Patent No. 5,440,749 or European Patent EP 0 870 226 or any patents claiming priority of one of these patents).
