THE COURT: HOLD ON, MR. COOPER. THAT'S
A LONGER ANSWER THAN -- ONE OF THE PRACTICAL
FACTORS THAT I NEED TO EVALUATE IS HOW LONG IS IT
LIKELY TO TAKE?
IF PEOPLE ARE FILING SERIAL APPLICATIONS,
THEN IT COULD VERY WELL TAKE YEARS; AND I THINK
THAT POINT IS VERY WELL TAKEN.
BUT AS I UNDERSTAND IT, ALL OF THE
APPLICATIONS HAVE BEEN FILED AND REEXAMINATION HAS
BEEN GRANTED AS TO A SIGNIFICANT NUMBER OF THE
CLAIMS. AND IT'S THOSE CLAIMS THAT ARE ALREADY IN
THE OVEN, AS IT WERE, THAT I'M MOST INTERESTED IN.
WHEN ARE WE LIKELY TO GET A RESPONSE ON
THOSE, BECAUSE I THINK -- IF I'M GOING TO GO AHEAD
AND START CONSTRUING CLAIMS AND HAVE A MARKMAN
HEARING AND SO FORTH, I DON'T WANT TO HAVE TO DO
THE SAME JOB TWICE.
I could be wrong but was it not posted that the Judge might consider using the prior Markman ruling.................Corrections welcome..............Why do it twice if needed......
