Others were possibly in negotiations or willing to start negotiations when the USPTO accepted to review the new challenge of the 336 and issued it to a new examiner. Are we not waiting near three months to see if the USPTO accepts this review???? Would this not put all companies in negotiations in limbo again????

Exellent question wannabe... one I wish I had an answer to. Why didn't the PTO just tell them to stick this request?
