In my opinion, the way it was done is the equivalent to someone who is in the process of selling their house, they're about to close escrow with a perspective buyer who has small children. They find out that the City has just agreed to build a beautiful park a block away. They tell the buyer of this development. That same day, they find out that the house is build on contaminated soil. However, per the law, they have 4 days to disclose this discovery. In the meantime the buyer decides to close on the house immediately as they fear the prices are about to start going up, so they close the day after the park revelation. 3 days after that, they get the letter regarding the contaminated soil.
The obligations of disclosure were "met".
