The Defense included invalidity and obviousness contentions, and from memory these were dismissed without prejudice. This made me ask at the time something along the lines of what was the point in retaining a defense if the matter had been fully concluded with no further action envisaged.

Having been granted a license, the terms of which are covered by the MOU and NDA, still makes them licensees - they are not excluded from the total by virtue of it being a grant as opposed to a purchase.

As lawyers were all over the case, I do not believe that the PR notification of the resolution was left solely at the discretion of TPL/PTSC and suggest that the precise wording was agreed upon by all sides to ensure compliance with the MOU/NDA.

Therein lies the beauty of the PR as it is as clear as mud and makes your suggestion no less valid than any other.
