Opty... I have to agree with your opinion/post.. I went back and reread (instead of relying on my memory, like I had done at work this AM.. my very bad) the part from the request on which I was basing my opinion, it states: The questions of patentability presented herein are new even with respect to the pending reexamination proceedings. I erroneously remembered it as 'with respect to the amended claims' and posted as such. There is a big difference.
