I didn’t study only briefed through the re-exam request, it looked as though USPTO based the re-exam on a combination of the same prior art but the same prior art in combination in a attempt at a conception of common knowledge. It seemed as though it was a twisting of the words of the first exam. Since I don’t have an overabundance of time these days I have also briefed through a few rules at the USPTO. I think that I have read that once the patents are proven in a civil court they can then be confirmed by the USPTO. If that is correct then could they also be proven by a German civil court or the Germen PTO?Then again that probably doesn’t mater since the ruling on the re-exam will be finished first. I am sure the opposing legal defenses are in contact with each other and they are all working together. Patients is the key when the rest of the world is conspiring against you.
