I'll assume that your post is legit.

Regarding the 148 patent reexam 90/008227. There is a Nov 23rd supplemental amendment which I am assuming is the result of discussions with the examiner subsequent to our resposes to office actions. The amendment is only reinstating the original version of claim 9, which had been amended previously.

So, I'm assuming that the we have not only have agreement with the examiner with respect to the reinstatement of claim 9, but all the other claims as well.

If this is indeed the case, we have essentially all the orginal claims unamended. If in the NIRC that way it means way more $$$$$ and little for the infringers to hang their hat on in court.
