One would think that since this new re-ex request was assigned to the same Group Art Unit 3992 that issued the NIRC, the request should have been denied.

From what you're indicating, the new examiner (Peikari) that took over from Rimmel should have known of the prior art of record. Me thinks the re-ex was granted due to some sort of technicality or he simply overlooked what was on record, which is doubtful because the examiners in the same GAU must be in communication with each other. Either way, as I have said before...this request should be easily blown out of the water IMNSHO
