I thought the quota of post may have been low for the day and you were looking solicit a few extra for the day. I noticed in the patent prosecution selection of 11-14-2009. There was a recommendation by the examiner for the 336 amendments in April 1998. The amended patent was published in September 1998. If we are on the same time table expect the publication of the newest 336 publication in May 2010. I have come to the realization that this is just a bogus examination and has been filed in order to keep the court ground to a halt by clouding the validity. If this reexamination did not exist there wouldn’t be any reason not to lift the stay in the courts and continue the case. This reexamination is just the half time entertainment and attempt to run down the clock until the new 336 is published and another more viable reexamination can be requested based on the revised patents. This must be a junkyard dog of a patent to go to all t hat trouble. At least Baroni and Mystry think so, or else why would they be working for us? How do they expect to get paid unless the money faucet is open? It will be interesting to see how many lawsuits are loaded into the breach when this smoke and mirrors business is over with.
