I didn’t check, part of that issue could be the person that accepts the request verses the examiner. Two different people. The examiner was not very pleased with the first request. I wonder if some guidance was offered by the examiner via personal conversation to get the reexamination acceptable.

There is the other possibility that the original request for reexamination was purposely written to be turned down in anticipation of the revised 336 being completed at a later date and included.
