Well Steve, I'll try and respond to your post the best I can. For clarity, since you thoughtfully put the excerpts from my post in italics, I'll refer to your post paras using numbers in same sequence (does that make sense? It's pretty bad when I question myself on my method of assuring clarity! LOL I'll try to phrase my responses to help.).
1. I think there is an end to the PTO saga for the reasons stated in my post. There is not a bottomless pit of potentially VALID prior art out there, and I strongly suspect that whatever was out there has been found and thrown at us already. A request for re-exam must present evidence/arguments adequate to compel the PTO to act (vs, reject).
2. Yup, Cook was a disappointment IMO. But look at the result! We basically won the Markman. Now consider if/when we have someone sharper than Cook in the game.
3. I don't feel smarter either, TODAY. We're IMO waiting for the other shoe to drop - for the PTO to do something (reject in light of re-cert or whatever) the latest re-exam/perceived threat. And that applies re: PDSG as well - what's the plan, man? Though IMO whatever happens with PDSG or anything at PTSC itself is dwarfed by the significance of the MMP and, currently, the '336 in particular.
4. My take on the PPS is that holders of this stock are (in sequence):
- suffering the brunt of hard times and simply need cash, especially around the holidays.
- doing some year end tax loss selling to offset gains made elsewhere in the turn-around of the NYSE/NAS.
- tired of waiting (and probably not watching close enough)
- reacting to degrees of uncertainty on multiple fronts
- reacting to waves of goofy posts on message boards - isn't it interesting that once the .18 barrier was solidly broken and we slipped, those goofy posts stopped? Mission accomplished? If one takes this seriously, it's pretty obvious. Perhaps no direct cause-effect, but the behavior is revealing.
The other things you mention are also probable influencing factors, but they'd be (as here) at the bottom of my list, and perhaps categorized under "goofy posts" (making a huge deal over things that are unknowns or non-issues).
5. I think we've all been trying to wrap our heads around the MMP (and PTSC) for years. I swear there is a curve forming in mine, making it more difficult to get a straight part in my remaining hairs! LOL
Hope this helps!
