Reexam request are just damage control. They all know they are infringing they are just trying to negate past infringment by trying to have the claims changed. Next, the arguments in court will be whether the remaining claims are new (if so then no past infringment-only going forward), or are the changes only meant to be for clarification of the patent. (if so then past infrigment will be allowed). The only way around our patents has been blocked by Moore and TPL with the VNS patent portfolio (IMO) So, they can pay us now, or whoever later. Licensing would seem to be a much better alternative because eventually we are going to get into willful infringment territory. So, once the degree of infringment is established then we will get back to more revenue from licensing. I am just hoping that the pace will start to accelerate.
