Again, we spoke in general terms and not specifically about the 336. However, I did notice today that this particular supervisor's name is on the cover page of the reexam litigation document in the image file wrapper. My specific question to him was in reference to the 60 day waiting period for the patent owner to respond. I was surprised to learn that for tactical purposes most patent owners do not respond....which eliminates a further response from the requestor.
