Would you not consider the taking of a public company private a "hostile takeover"?

However, you are absolutely correct that if all parties to the MA agreed to modify that contract, or supercede it with a new agreement, anything could be done. The question becomes, how would such action be advantageous to TPL/Moore? Per the existing MA, they have pretty much all the control.

In any case, IMO the thought of some entity being able to and succeeding in taking PTSC private is pretty ridiculous. Take a look at our float.

Sure, anything may happen - and the sunny might not come up tomorrow morning. Also, this discussion IMO is pretty obvious FUD. After all, what is the foundation for this speculation, really? A guy associated in some way with a consultant engaged by PTSC was once involved in taking a company private? That's the smoking gun? Why not take it all the way to 6 degrees of separation and suggest that PTSC is a front for al queida?
