That's a stretch.

You say "the company has admitted that there is no auditing function in place".

There is an Accounting System in place, and it can be audited.

And I'm sure it is being audited via the TPL/Moore dispute. In such an audit, the auditors will (should if they are competent) correct any and all accounting deficiencies, regardless of which person/entity was impacted.

And BTW, there is an auditing function in place - it's called the IRS.
