Yesterday was the deadline for TPL to either respond to the determination of the granting of the reex or waive the right to. As of 3:38 today, nothing has been posted.

TPL's response to the non-final office action of the '890 reex was received on the 2 month deadline (Jan. 5, 2010) but has yet to be posted for viewing. Under "Application Data" it shows "Response after Non-Final Action Entered (or Ready for Examiner Action)" and the Status date indicates Jan. 13, 2010. I wonder if that indicates the examiner Pokrzya is busy preparing his "Action"?

...and busy he is. Mr. Pokrzya is the examiner for the merged '749 and '148 reex's as well.

Yes...time will tell how these decisions will effect the shareprice and that time is fast approaching.

BTW...Jan. 19, 2010 will be 2 months from the non-final office action of the merged '749 reex. and Feb. 11, 2010 for the merged '148.
