Well, if you're talking about the new '336 reex app#90/009,457, it seems that the deadline has passed since Jan. 14 for TPL's option to waive the right or not to respond to the reex determination. Corrections welcomed, but we are now waiting for the first Office Action which could either be Termination, a Non-Final, or Final.

Termination would end it immediately. Given that there is already a Recert Issued, I am at a loss as to what exactly would happen since normally a Notice of Intent to Re-Issue a Certificate (NIRC) would be posted.

A non-final action would mean more clarification is needed by the examiner to make a decision.

A Final action would grant or reject the certificate but allow for an appeal (as was the case in the '336 recert that was initially given a Final rejection).

I am not sure if a 2 month deadline applies to all scenarios and corrections are welcomed.
