I think you're point is semantics. The re-exam "request" was determined "ordered", so at this point, I believe the only positive outcome ulitmately will result in an NIRC. So, while dismissed may be the technically incorrect word, I believe by issuing the NIRC, especially if the claims remain unchanged, is in essence a dismissal, and what I meant to convey.
