Today I spoke with a supervisor in the art unit overseeing the 336. What she told me is that she can only speak to the public statistics which can be found at the USPTO website.
1. Avg. time to first office action 7.6 months. In theory, a re-examination after a NIRC should be treated with special dispatch...however, this isn't necessarily how it plays out in the real world. She said the MPEP was written in 1990 when there were a lot less re-exams pending....so expecting an office action this week, seems highly unlikely.
2. As of today, no office action has yet been conferenced by the examiner
3. If looking in public pair.....any new information will first hit the transaction history before it shows up in the image file wrapper. It sometimes will take 2-3 days to show up in the file wrapper because the mail room is not accustomed to re-exam scanning which is a slow process.
