The agreement to transfer the case was on the basis of judicial efficiency. Exactly what efficiency would be gained if there is a trial in Calif and a trial in Texas? Wouldn't that be the same as a trial in NY and a trial in California? There is absolutely no benefit to the court system to have a trial in Texas or NY if one is ongoing in California. There's going to be a Markman in California no matter what happens to the SIRIUS case. There is no efficiency in two separate Markmans that might come up with different claim interpetations.
