I believe I may have found something of interest. In the transmittal CFR 1.97 is referenced as well as CFR1.98(a)(2).

The last IDS filed by the patent owner for 90/009474 only referenced CFR 1.98(a)(2).

The last IDS filed by the patent owner for 90/009225 only referenced CFR 1.98(a)(2).

For some reason 1.97 was added this time. Why added here and not for the other two reexams? After the last fiasco, I'm not going to assume or interpet anything. Just pointing out something appears to be different on the 148.
