Their argument is that DL should be prohibited from any direct discussions with HTC in the belief that he is an attorney for the defense, not that HTC do not want to talk to him.

Should they be correct, DL's actions were wrong and he deserves it. However, if this move were just a tactic, in the knowledge that DL wasn't an official member of the defense, the Judge will have sight of otherwise "confidential" material.

I'm sure that our resident Juris Doctor will elaborate on the ramifications, as I will not be doing so.

Incidentally, there would be nothing to prevent Mac Leckrone, as a non-lawyer, having the same discussions with HTC.
