On Nov 14 there was an ex parte communication transmittal form that went to the attorney (Henneman) which stated that the re-exam filed August 24, 2009 was granted.

June 24, 2010 will be ten months since the filing and no first office action from the examiner. My question still remains, with litigation pending during this re-exam, will the OPLA step up on August 24, 2010 and approve an action, if there has been no first action by the examiner?
