I really don't know for sure but I think that right now it is the USPTO's move and the delay is because there are few resources and a whole lot of work for the examining unit. June 24th will be 10 months since this re-exam was granted. In a perfect world, the MPEP states that a reexam where litigation is pending should be expedited. I guess right now that would mean a first office action before 24 months which was how long it took for the last re-exam to reach conclusion.
If Henneman (attorney) had some how been involved in asking for a delay, which I doubt, wouldn't it seem logical that he would have to put something in writing which would then be posted on the USPTO website? Anyway, it's a guessing game for all of us.
Isn't it only four more months till the annual shareholder's meeting? Perhaps the BoD is waiting till then to give us some news :).
