Question re: Patriot vs. TPL

The entire relationship between TPL and Patriot is based on the MMP, correct?

TPL has defaulted on a loan made by Patriot and the court has ordered the documents relating to this case be sealed, correct? So we don't know the full story of what this litigation is about. Might be about more than just the loan, however, isn't all litigation that could have an effect on the MMP supposed to be reported to the USPTO examiner?

In other words, if the patent owners are fighting and there is no money coming in to continue to defend the patents or pursue additional licenses until another NIRC was granted, wouldn't this be yet another reason for the USPTO to speed things up?
