In addition to the suggestions you noted, how about the extension of patent validity for the time in reexamination beyond the original request? It is too easy for the third party requestors to get the USPTO to grant new reexams. If the USPTO can not change that, then at least recognize that 2nd and subsequent requests are, in all liklihood, simply delaying tactics by litigants. And the subsequent requests ought to cost more as well.
